The litigation process usually starts with a “demand letter” to the other party setting out your position. If the problem cannot be resolved through negotiation, then people have the option of starting a civil legal proceeding to ask a Court to decide what should happen. While many disputes require parties to start legal proceedings, few cases ever go to a trial. Through the civil litigation process, parties and their lawyers learn more about the facts and legal positions and often settle the dispute at some point before a trial.
